Terms of Service for Swapbl

1. Agreement to Terms

Welcome to Swapbl! These Terms of Service ("Terms") govern your access to and use of the Swapbl mobile application ("App," "Service," "we," "us," or "our").

By accessing or using Swapbl, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Eligibility

Age Requirements

  • You must be at least 18 years old to use Swapbl
  • By using the App, you represent that you meet this age requirement
  • We reserve the right to verify your age and terminate accounts that do not meet this requirement

Account Eligibility

You must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Accept all risks of unauthorized access to your account
  • Not have been previously banned from Swapbl

3. Account Registration

Account Creation

To use Swapbl, you must create an account using:

  • Apple Sign In
  • Google Sign In

Account Responsibility

You are responsible for:

  • All activities that occur under your account
  • Maintaining the confidentiality of your account
  • Notifying us immediately of any unauthorized access
  • All content posted through your account

One Account Per Person

You may only maintain one account. Creating multiple accounts may result in suspension of all accounts.

4. How Swapbl Works

Platform Purpose

Swapbl is a local trading platform that enables users to:

  • Post items they wish to trade
  • Discover items posted by others in their area
  • Express interest in trading for items
  • Communicate with other traders
  • Complete item-for-item exchanges

Not a Marketplace

Swapbl is not a buying/selling platform. We facilitate:

  • ✅ Item-for-item trades
  • ✅ Exchanges of similar value
  • ❌ Cash sales
  • ❌ Commercial transactions
  • ❌ Business-to-consumer sales

5. Posting Items

Item Requirements

When posting items, you must:

  • Provide accurate descriptions
  • Upload clear, representative photos
  • Specify a reasonable estimated value
  • Accurately describe item condition
  • Post items you actually own and can trade
  • Not post prohibited items (see Section 7)

Item Ownership

You represent and warrant that:

  • You own the items you post or have permission to trade them
  • Your items do not infringe on any intellectual property rights
  • Your items are legal to possess and trade
  • Your item descriptions are truthful and not misleading

Item Availability

You must:

  • Remove or mark items as unavailable when traded
  • Respond to trade interests in a timely manner
  • Update item status if circumstances change

6. Trades and Transactions

No Guarantee of Trades

Swapbl does not:

  • Guarantee that trades will be completed
  • Verify item authenticity or condition
  • Act as a mediator in disputes
  • Take possession of items
  • Handle payment or financial transactions

User Responsibility

You are solely responsible for:

  • Inspecting items before completing trades
  • Verifying item condition and authenticity
  • Meeting safely in public locations
  • Completing trades at your own risk
  • Any disputes arising from trades

Safety Recommendations

We recommend:

  • Meeting in public, well-lit locations
  • Bringing a friend to trade meetings
  • Inspecting items thoroughly before accepting
  • Trusting your instincts
  • Reporting suspicious behavior

No Cash Transactions

Swapbl is for item-for-item trades only. Do not:

  • Offer or request cash payments
  • Use the platform for buying/selling
  • Conduct commercial transactions
  • Engage in business activities

7. Prohibited Content and Conduct

Prohibited Items

You may not post items that are:

Illegal Items:

  • Illegal drugs or controlled substances
  • Weapons, firearms, or explosives
  • Stolen property
  • Counterfeit goods
  • Items that violate intellectual property rights

Regulated Items:

  • Alcohol or tobacco products
  • Prescription medications
  • Medical devices
  • Recalled products
  • Hazardous materials

Prohibited Categories:

  • Live animals (exceptions may apply for rehoming)
  • Adult content or services
  • Body parts or fluids
  • Lottery tickets or gambling items
  • Services (Swapbl is for physical items only)

Prohibited Conduct

You may not:

  • Harass, threaten, or intimidate other users
  • Impersonate others or create fake accounts
  • Post false, misleading, or deceptive content
  • Engage in fraud or scams
  • Spam or send unsolicited messages
  • Use automated systems (bots, scrapers)
  • Attempt to circumvent security measures
  • Collect user information for unauthorized purposes
  • Interfere with the App's functionality
  • Violate any applicable laws or regulations

Commercial Use

You may not:

  • Use Swapbl for commercial purposes
  • Operate a business through the platform
  • Post items primarily for profit
  • Advertise or promote businesses
  • Resell items obtained through trades for profit

8. Content Rights and License

Your Content

You retain ownership of content you post (photos, descriptions, etc.).

License to Swapbl

By posting content, you grant Swapbl a:

  • Worldwide, non-exclusive, royalty-free license
  • To use, reproduce, modify, and display your content
  • For the purpose of operating and improving the App
  • Including promotional materials and marketing

Content Restrictions

You may not post content that:

  • Violates third-party rights
  • Contains explicit or offensive material
  • Promotes illegal activities
  • Includes personal information of others without consent
  • Contains viruses or malicious code

Content Removal

We reserve the right to:

  • Remove any content at our discretion
  • Remove content that violates these Terms
  • Remove content based on user reports
  • Not provide notice before removal

9. Intellectual Property

Swapbl's IP

All aspects of the App, including:

  • Design, layout, and graphics
  • Software and code
  • Trademarks and logos
  • Text and content created by Swapbl

are owned by Swapbl and protected by intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable license to:

  • Use the App for personal, non-commercial purposes
  • Access content through the App interface

You may not:

  • Copy, modify, or create derivative works
  • Reverse engineer or decompile the App
  • Remove copyright or trademark notices
  • Use our trademarks without permission

10. Privacy and Data

Privacy Policy

Your use of Swapbl is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Data Collection

By using Swapbl, you consent to:

  • Collection of information as described in the Privacy Policy
  • Use of location services for location-based features
  • Storage of your data on our servers (Supabase)

Communications

You consent to receive:

  • Trade-related notifications
  • Security alerts
  • Service updates
  • Policy changes

11. User Reports and Moderation

Reporting

You can report:

  • Inappropriate content
  • Prohibited items
  • User misconduct
  • Safety concerns

Our Actions

We may:

  • Investigate reports
  • Remove content or items
  • Suspend or terminate accounts
  • Cooperate with law enforcement
  • Take other appropriate actions

No Obligation to Monitor

We are not obligated to:

  • Monitor all user content
  • Review items before posting
  • Verify user claims
  • Mediate disputes

12. Account Suspension and Termination

Our Right to Terminate

We may suspend or terminate your account:

  • For violation of these Terms
  • For prohibited conduct
  • For fraudulent activity
  • At our sole discretion
  • With or without notice

Your Right to Terminate

You may terminate your account at any time through:

  • Profile → Settings → Delete Account

Effect of Termination

Upon termination:

  • Your access to the App will end
  • Your account data will be deleted (per Privacy Policy)
  • Active trades may be affected
  • These Terms will continue to apply to past activities

13. Disclaimers and Limitations of Liability

"AS IS" Disclaimer

SWAPBL IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability
  • Uninterrupted or error-free operation

No Guarantee

We do not guarantee:

  • That trades will be completed successfully
  • Item authenticity or condition
  • User identity or claims
  • Safety of in-person meetings
  • Availability of the App

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE ARE NOT LIABLE FOR:

  • Any indirect, incidental, or consequential damages
  • Loss of profits, data, or goodwill
  • Personal injury or property damage
  • Damages arising from trades or user interactions
  • Unauthorized access to your account

TOTAL LIABILITY CAP: Our total liability shall not exceed the greater of:

  • $100 USD, or
  • The amount you paid to Swapbl in the past 12 months (currently $0)

User Responsibility

You acknowledge that:

  • You trade at your own risk
  • We are not party to trades between users
  • We do not verify users or items
  • You are responsible for your safety

14. Indemnification

You agree to indemnify, defend, and hold harmless Swapbl and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of others
  • Your content or item postings
  • Trades you participate in
  • Your conduct on the platform

15. Dispute Resolution

Informal Resolution

Before filing a claim, you agree to:

  • Contact us at support@swapbl.com
  • Attempt to resolve the dispute informally
  • Provide details of your concern

Arbitration Agreement

Any disputes will be resolved through binding arbitration, not in court, except:

  • Small claims court actions (under $10,000)
  • Injunctive relief requests
  • Intellectual property disputes

Arbitration Terms:

  • Governed by the Federal Arbitration Act
  • Conducted by a neutral arbitrator
  • No class actions or representative actions
  • Award is binding and may be entered as a judgment

Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES ONLY ON AN INDIVIDUAL BASIS. NO CLASS ACTIONS, CONSOLIDATED ACTIONS, OR REPRESENTATIVE ACTIONS ARE PERMITTED.

Governing Law

16. Changes to Terms

If any provision is found unenforceable, the remaining provisions remain in effect.

No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

Assignment

You may not assign these Terms. We may assign our rights and obligations to any party.

Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.

If you access Swapbl through the Apple App Store, you acknowledge that:

  • These Terms are between you and Swapbl, not Apple
  • Apple is not responsible for the App or its content
  • Apple has no obligation to provide support

  • You comply with Apple's App Store Terms of Service
